Purpose

Management of personal data related to the entity’s legal defence, legal advice, and contracting.


Entity in charge


The legal bases for processing are:

  • Article 6(1)(b) of GDPR: Processing is necessary for the performance of a contract to which the data subject is a party or in order to take steps at the request of the data subject prior to entering into a contract.
  • Article 6(1)(c) of GDPR: Processing is necessary for compliance with a legal obligation to which the controller is subject:
    • Law 1/2000, of January 7, on Civil Procedure.
    • Law 36/2011, of October 10, regulating social jurisdiction.
    • Royal Decree of September 14, 1882, approving the Criminal Procedure Law.
    • Law 29/1998, of July 13, regulating the Contentious-Administrative Jurisdiction.
    • Royal Legislative Decree 3/2011, of November 14, approving the revised text of the Public Sector Contracts Law.

Data retention periods

Data will be stored for the time necessary to comply with the purpose for which they were collected and to determine the possible liabilities that could derive from that purpose and data processing. The provisions of the file and documentation regulations applicable to Navantia will apply.

Security measures

The security measures applied correspond to those provided in Annex II (Security Measures) of Royal Decree 311/2022, of May 3, which regulates the National Security Scheme in the field of Electronic Administration and are described in the documents forming part of Navantia’s Data Protection and Information Security Policy. Security measures corresponding to Annex A of UNE-EN/IEC 27001 - Information Security Management Systems.

Additionally, security measures are adopted for paper-based documentation according to the risks to which they are exposed, in order to ensure the confidentiality of the processed data.


Communication

Communications are foreseen when data can be communicated in accordance with GDPR Article 6, in relation to authorised processing of:

  • Spanish state-owned industrial holding company (SEPI)
  • Courts of Justice
  • Spanish Court of Audit

International transfers

Data transfers to foreign contractors are foreseen, including to the USA, Australia, the United Kingdom, and Saudi Arabia.
